The company name will be referred to as “Wheel of Persuasion” herewith.

These terms & conditions apply to anyone starting a course on “Wheel of Persuasion”. These terms and conditions are a contract between you (trainee) and Wheel of Persuasion.

Terms of Use:

All intellectual property rights, including copyright in all content and communication, belong to Wheel of Persuasion. By reading the Terms of Use you are agreeing that the content and property of Wheel of Persuasion cannot be copied, reproduced, modified, stored, redistributed, or exploited commercially in any way without permission from Wheel of Persuasion.

Terms of Use of this Website:

Wheel of Persuasion may change the content, which includes prices, offers, and content at any time. We do not provide a warranty or guarantee of the accuracy, completeness, suitability, timeliness, or performance of information or content on the website. If there are errors in the information provided in the content of the website we expressly exclude liability for these inaccuracies, to the fullest extent that the law permits.

You can use any of the information or content at your own risk for which Wheel of Persuasion will not be liable. It will be your responsibility to ensure that any products you purchase are suitable to your current requirements.

All of the online courses in the website and brochure are provided by Wheel of Persuasion and are subject to the following conditions:

1. Course Requirements (all of the courses provided in English):

By starting courses with Wheel of Persuasion you (the student) confirm that you meet the following minimum requirements of the course.

    1. All customers of the courses must be at least 16 years old at the time of booking.
    2. All customers must have a competent native level of English and possess a reasonable competence in English language reading, writing, and speaking skills.
    3. All candidates must have the ability to take advice from tutors and from peers and have the capability to make improvements to their results if required.By making a booking with Wheel of Persuasion it is assumed that the candidate satisfies the above conditions and is deemed to have a competent level of English. The candidate, by making a booking, takes full responsibility in determining whether the course is suitable for their level of English. Wheel of Persuasion takes no responsibility if the candidate is unable to complete and pass the course.
    4. If Wheel of Persuasion feels at any point during the course that the candidate’s level is below a sufficient level, as per the conditions, Wheel of Persuasion will forward their concerns to the Director of Studies. If the tutor and the Director of studies believe the candidate to be below a sufficient level Wheel of Persuasion reserves the right to fail the candidate.
    5. Before purchasing any of the “Wheel of Persuasion” courses you should contact a member of staff and check whether you are suitable for the courses. Please contact a member of staff to check your level of English language and suitability for the course.
    6. Wheel of Persuasion does not accept any liability for any losses, costs, or expenses incurred by or on behalf of a candidate in connection with a candidate’s insufficient language ability.
    7. It should be noted that purchasing any of the courses from Wheel of Persuasion does not mean that a candidate will be guaranteed a pass. Wheel of Persuasion reserves the right to fail a student if they do not meet the minimum requirements of the course.
    8. The Student will make a full declaration of any information deemed to be relevant by Wheel of Persuasion.
    9. The Student agrees to follow any of the policies and regulations set down by Wheel of Persuasion.

2. How to make a booking:

 

  1. Booking can be made online on our website www.WheelofPersuasion.com . The person making the booking must be at least 18 years old and by paying for the course accepts the terms and conditions. Wheel of Persuasion states that by paying for a booking you have read the terms and conditions. You are also responsible for the accuracy of your personal details. Wheel of Persuasion will only deal with you in the event of cancellations or disputes.
  2. You must make full payment at the time of booking. Wheel of Persuasion does not accept deposit or partial payments or installment payments. All payments not made with a debit card will be subject to a fee. Once your booking has been accepted you will receive an invoice within 24 hours from the time of purchase. Once that invoice has been generated a contract exists between you and Wheel of Persuasion and all terms and conditions apply. Once you have received this invoice please go ahead and check it and inform us of any changes to personal details and contact information.
  3. Once Wheel of Persuasion has received your payment for the course Wheel of Persuasion will email you a login username and password with 24 hours to allow you to access the course.

3. Price of Courses:

 

  1. All prices that are advertised on our website are correct at the time of booking. However, Wheel of Persuasion reserves the right and discretion to change our prices at any time. Please check our website for up-to-date prices and special offers before you book.
  2. Once you have paid for a course you will be sent an email confirmation with 24 hours of payment. If you do not receive an email then please contact us at info@wheelofpersuasion.com.
  3. Wheel of Persuasion reserves the right to change any of its prices at any time.

4. Procedure for changing or canceling a booking:

  1. Cooling-off Period:
    Under the Consumer Protection (Distance Selling) Regulation 2000 you the consumer have the legal right to cancel the contract between you and Wheel of Persuasion during the period of 14 days from the date of the issue of the confirmation invoice, which is when the contract starts. This is known as the “cooling-off period”. If you decide to cancel the course within this cooling-off period then you must inform us within 14 days of the confirmation invoice. Once we receive your written cancellation, in form of an email we will refund your course fees within 30 days.Once you have completed the cooling-off period of 14 days you will be under the full cancellation conditions of courses which are 100% non-refundable.If you log in to the Course you will be deemed to have started the course and will no longer be able to get a full refund, even if it within the 14-day period.

    However, if you need to change the start date of a course for any other reason, our Director of Studies will consider this, and you will be able to change the start date for a fee of €30 if agreed by our Director of Studies.

  2. You must inform us of your intent to cancel by writing to support@enjoyonlinecourses.com in the form of an email.
  3. Once we have received your written cancellation letter we will refund you within 30 days of receiving your letter and deduct any credit card surcharge, if applicable.
  4. Once you have canceled your booking your login details will be canceled immediately.

5. Time Period for the completion of courses:

  1. All courses have a time period of 12 months to complete the course.All students have 180 days for the Online TEFL course, which includes free access to the Mindfulness Course for Individuals and Children Courses. This starts when a student enrolls by entering their username and password. All other courses offer a 12-month access period.
  2. Extension: If you fail to complete the course in 12 months then you may extend the course by paying €20 for 6 months prolonged access. You may do this as many times as you feel necessary (please contact us at info@wheelofpersuasion.com if you need to discuss any extensions).

6. How to pass the course?

  1. Purchasing a course, does not automatically guarantee that you will pass the course. If you fail to meet the requirements of passing a course then Wheel of Persuasion reserves the right to fail you.
  2. Between modules check tests are typically mandatory, but failing these does not prevent moving from one module to the next (they are used to help trainees understand how well they have understood and are able to apply the teaching material).
  3. Each Wheel of Persuasion course is concluded by a final Assessment section. This assessment section typically consists of a multiple choice exam.
  4. Once you have been awarded a fail then you will not be entitled to a refund.
  5. We reserve the right to fail a student, if a student is not meeting the standards of the course in terms of learning, English language ability, or plagiarism.

7. Plagiarism:

  1. If any student is found to have copied another student’s work then they will be issued with 1 formal warning. In subsequent cases the student will be deemed to have taken part in plagiarism and be failed. In the event of plagiarism, no refund will be given to the student.

8. Certificates:

  1. We use the following success levels for our certification:
    – The trainee has not watched the mandatory video lessons, or taken the mandatory tests: No certificate
    – The trainee has watched the mandatory video lessons, and taken the mandatory tests: Certificate of Attendance
    – The trainee has watched the mandatory video lessons, and scored between 75% and 85% at the final assessment: Certificate of Succesful Completion
    – The trainee has watched the mandatory video lessons, and scored between 85% and 95% at the final assessment: Certificate of Succesful Completion – Cum Laude
    – The trainee has watched the mandatory video lessons, and scored between 95% and 99% at the final assessment: Certificate of Succesful Completion – Magna Cum Laude
    – The trainee has watched the mandatory video lessons, and scored 100% at all the mandatory tests, including the final assessment: Certificate of Succesful Completion – Maxima Cum Laude
  2. Every student who is entitled to receive a certificate, will receive a PDF with the certificate by email within 14 Days of passing the Course.
  3. If you would like to receive a hard copy with a hand written signature of your certificate then there is a charge of €15 per Certificate. Wheel of Persuasion will do everything possible to make sure that you receive your certificate within 30 days of passing the course. However, we do not take any responsibility for any postal service problems, which might delay your certificate and we do not take responsibility for a lost certificate due to in-country postal problems. We can provide proof that the Certificate was sent to your confirmed postal address. This covers all geographic locations.
  4. Wheel of Persuasion will supply you with a new certificate in the event of loss or damage for a fee of €15.

9. System Maintenance and Upgrades

At certain times our systems and software programs will be updated. In the event of an update will we endeavor to do this work as quickly as possible. However, if our systems are not working for a period longer than 72 hours then will allow our candidates to extend their course (up to 72 hours). This is not limited to just System Maintenance and Upgrades. It should be noted that no refund will be given for the unavailability of the website lasting up to 72 hours. However, if our systems are not working for a period longer than 72 hours then we will allow our candidates to extend their course (up to 72 hours).

10. Limitation of Liability

Wheel of Persuasion does not accept any liability for any loss or additional expense caused by delay or disruption to travel services, weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness, or force majeure. Such losses or additional expenses are your responsibility. Force majeure represents unusual or unforeseeable circumstances, which include: war, terrorist activities, riots, natural disasters, or nuclear disasters such as fire, flood, or adverse weather conditions.

11. Complaints

If at any time, you are unhappy with the Wheel of Persuasion service then please contact us immediately at info@wheelofpersuasion.com.com and we will endeavor to respond as quickly as possible but no more than 30 days following the receipt of your complaint.

12. Accuracy of Marketing Materials

Wheel of Persuasion makes every effort to ensure that the marketing material on our website is up to date and accurate. We take no responsibility for any information that is deemed incorrect and we will endeavor to do our best to inform you of any changes to the course. We reserve the right to change any of the information on our website at any time we feel appropriate.

13. The Law and its Jurisdiction:

These terms and conditions and any dispute or claim arising out of and in connection with them or their subject matter (including no contractual disputes or claims) shall be governed by and shall be construed in accordance with Dutch Law and the Courts of Amsterdam and Utrecht shall have exclusive jurisdiction over any claim arising out of it.

14. Third Party Rights:

A person that has no connection to the course shall have no rights in the contract.

15. Changes to Terms and Conditions:

Wheel of Persuasion reserves the right to change any of these conditions at any time deemed necessary to reflect current market and economic conditions.

16. Severance:

If any party finds any of the terms and conditions in this document to be deemed illegal, invalid, or unenforceable then these parts will be deleted while the other parts of the terms and conditions will be deemed valid.

17. The Courses:

The Courses and the relevant login details are solely for your use. Another party cannot use these details.

18. Acceptance of these terms and conditions:

By reading these terms and conditions, verbally agreeing on the telephone, or making payment on the website you are accepting all terms and conditions of Wheel of Persuasion.

Please be aware that we do our best to respond to contact emails as quickly as possible. We have very high customer service expectations and will endeavor to reply to your contact email within 24 – 48 hours after receipt of your email. 20. Controlling your Personal Information:

Please be aware that you as an individual can choose to allow your personal information to be used by businesses at any time. You can manage your preferences and computer systems to disable setting on your personal computer.

21. Copyright:

All material on this website is owned by Wheel of Persuasion. This includes all material, video and audio, graphics, content, design, appearance. As per the Terms and Conditions, no material on this website or related courses can be copied or reused by anyone without the permission of Wheel of Persuasion.

22. Mental Health Disclaimer:

Please note that the courses are not mental health courses. In the website and the courses, we acknowledge there is research to support mental health benefits but this is in no way guaranteed. If you have any pre-existing conditions then we advise you to consult a mental health doctor before you begin the course.

23. Third Party Platforms (resellers and in-company academy platforms)

We welcome all resellers and in-company academies to resell our courses, but we have (minimum) requirements:

  1. All Resellers must have a written approval by Wheel of Persuasion, unless we have actively published a course(s) on a reseller or in-company academy platform.
  2. Wheel of Persuasion has the right to reject any trainee submitted by resellers and in-company platforms, or retract courses from these market places and platforms.
  3. All courses will be hosted on Wheel of Persuasion servers.
  4. If a user purchases a course from the Wheel of Persuasion via a reseller, an email confirmation will be sent to the learner and the reseller.
  5. The reseller or in-company academy owners will take full responsibility for enrolling the learner in the course.

24. Once you accept the following Terms and Conditions you enter a contract between Wheel of Persuasion and yourself.

Wheel of Persuasion reserves the right to change any of the content, material, prices, offers or time period of the courses at any time. We advise you to read and accept the terms and conditions at the time of booking.

25. Device Requirements:
